Terms of Use

Important: By using Eventable, you agree to these Terms of Use. Violation may result in immediate account suspension or permanent removal.

These Terms of Use ("Terms") govern your use of the Eventable mobile application and related services (collectively, the "Service"), operated by Shiny Data LLC ("Eventable", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. Please read them carefully before continuing.

1. Eligibility and Accounts

You must be at least 13 years old to use the Service. By using Eventable, you represent that you meet this requirement and that the information you provide is accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. Zero Tolerance for Objectionable Content

We maintain a zero-tolerance policy for objectionable content and abusive users, including:

  • Harassment, bullying, or intimidation
  • Hate speech or discrimination
  • Obscene, pornographic, or graphic content
  • Spam, scams, or unsolicited advertising
  • Threats, violence, or illegal activity
  • Sharing others' private information without consent

Enforcement: Any content violating these Terms will be removed, and the user responsible may be ejected from the platform and permanently banned without notice.

3. Community Conduct

Be respectful and courteous. All posts and messages should be relevant to the event or community. Illegal, defamatory, or threatening behavior is strictly prohibited.

4. Reporting and Moderation

How to Report: You can flag any objectionable content or abusive user using the report button available on messages and user profiles.

24-Hour Response Commitment: Our moderation team reviews all reports and acts within 24 hours by removing objectionable content and ejecting users who violate these Terms.

5. Blocking Abusive Users

You have full control: You may block any abusive user at any time from their profile or message actions. No approval required.

What blocking does: Blocked users cannot send you messages, see your posts, or interact with your content. You can unblock users anytime from Settings → Blocked Users.

6. SMS Messaging Terms

By providing your mobile phone number and consenting to receive SMS messages from Eventable, you agree to the following:

  • Eventable may send you one-time passcodes for account authentication and, if you separately opt in, event-related notifications about events you create, attend, or RSVP to.
  • Message frequency varies based on your activity within the Service.
  • Standard message and data rates may apply per your wireless carrier agreement.
  • You may opt out at any time by replying STOP to any message, or by removing your phone number from your account settings.
  • Reply HELP to any message for assistance, or contact us at support@eventable.online.
  • You confirm that the phone number you provide is your own and that you are authorized to receive SMS at that number. You agree to update your account if you change or relinquish the number.
  • Eventable does not share, sell, or rent your mobile phone number, mobile opt-in information, SMS consent data, or any related personal information with any third parties or affiliates for marketing, promotional, or any other purposes.
  • You may withdraw consent to receive SMS at any time without affecting your right to use other features of the Service.

Carriers are not liable for delayed or undelivered messages. Eventable uses AWS End User Messaging as its SMS delivery provider, acting on our behalf under contractual data-handling obligations. For full details on how we handle SMS data, see our Privacy Policy.

7. Acceptable Use

You agree not to (a) reverse engineer, decompile, or disassemble the Service; (b) use the Service to violate any law or third-party right; (c) interfere with or disrupt the Service or servers; (d) access the Service through automated means without our prior written consent; or (e) use the Service to send unsolicited messages or to impersonate any person or entity.

8. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in objectionable conduct. You may terminate your account at any time from your account settings or by contacting us at support@eventable.online. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including SMS terms regarding consent and data handling, dispute resolution, and limitation of liability) will survive.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Eventable disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, Eventable and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of or related to these Terms or the Service will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid us, if any, in the twelve months preceding the claim.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last Updated" date above and, where appropriate, by additional notice within the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
